Sales Agreement & Health Guarantee

Section 1 — Sale Conditions

At BlackMoon Maine Coons, every kitten is raised with care, attention, and proper veterinary supervision. While every effort is made to ensure the health and well-being of each kitten, the Buyer understands that living animals can occasionally develop illness despite the best care.

• The kitten must be examined by a licensed veterinarian within three (3) days of pickup or delivery, excluding Sundays and holidays. This step ensures the health guarantee remains valid.
• The kitten will be kept strictly indoors only for its safety and well-being.
• The kitten will receive proper nutrition, veterinary care, and daily affection.
• Declawing is strictly prohibited. The Buyer agrees never to have this kitten declawed.
• If the Buyer becomes unable to keep the cat for any reason, the Breeder retains first right of return and must be contacted prior to any attempt to rehome, sell, or surrender the cat.

Section 2 — Deposit and Payment Information

A deposit is required to reserve a kitten and secure placement on the BlackMoon Maine Coons waitlist.

• The waitlist deposit is $200 and is non-refundable. This reserves the Buyer’s place on the list in order of deposit received.
• Once a kitten is assigned, the remaining $300 deposit balance is due, bringing the total deposit to $500.
• The Sales Agreement must be signed and the full $500 deposit paid at the time of kitten assignment.
• The $500 deposit is applied toward the total purchase price of the kitten.
• The remaining balance is due in cash at pickup.
• Deposits are non-refundable but guarantee kitten placement within eight (8) months of the initial waitlist deposit unless unforeseen circumstances prevent placement. In that case, the Buyer may choose to extend the wait or receive a full refund.
• Accepted payment methods: Cash, PayPal, or Venmo.
• Venmo: @blackmoonmainecoons — 8311 are the last four digits of the phone number. Please ensure it is the correct account before sending.

Section 3 — Vaccinations and Deworming

All kittens receive FVRCP vaccinations at 8 and 12 weeks of age and are routinely dewormed prior to placement. Each kitten is examined by a licensed veterinarian before going to its new home to ensure it is healthy and up to date on care.

Each kitten will undergo a full head-to-toe health check and will be sent home with a health certificate signed by a reproductive veterinarian.

The Buyer agrees not to board or expose the kitten to unvaccinated cats until the full core vaccination series, including FVRCP and rabies, has been completed.

Only core vaccines, FVRCP and rabies, are recommended, and they should be spaced out — no more than one at a time — to reduce risk of vaccine reaction. The Feline Leukemia vaccine is not recommended due to potential adverse effects.

Section 4 — Health Guarantee

The kitten is guaranteed to be free of viral and bacterial illness for three (3) days following receipt and free from life-threatening genetic defects for one (1) year from the date of sale.

If a life-threatening genetic defect is diagnosed within that period, the Breeder’s liability is limited to replacement of the kitten with one of comparable quality. No cash refunds or reimbursement of veterinary expenses are provided.

Acknowledgment of Responsibility

I understand that a kitten is a living being and not a guaranteed “perfect product.” Despite the best care and testing, health issues can arise that are beyond the breeder’s control. By adopting this kitten, I accept full responsibility for all veterinary care, treatment decisions, and financial costs once the kitten leaves the breeder’s care.

I agree that the breeder is not financially responsible for illness, injury, or medical conditions that may occur after adoption.

Section 5 — Non-Disparagement Agreement

The Buyer agrees to contact BlackMoon Maine Coons directly regarding any concerns before making public posts or complaints. The Breeder will act in good faith to resolve any issues and maintain a positive and professional relationship.

Section 6 — Spay/Neuter and Ownership Agreement

All kittens sold as pets are placed under a spay/neuter agreement and may not be used for breeding purposes.

The Buyer understands this kitten is sold as a companion animal only and agrees to provide proof of surgical spay or neuter by a licensed veterinarian no later than 10 months of age.

Recommended alteration ages: Females 6–9 months; Males 7–10 months. Early alteration may void the health guarantee.

If Buyer fails to provide satisfactory proof of spay/neuter within the time period required by this Agreement, Buyer will be in breach. In addition to any other remedies available at law or in equity, the Breeder may repossess the cat without further notice and recover from Buyer all losses and expenses caused by the breach, including consequential damages, costs of repossession, veterinary and boarding costs, court costs, and reasonable attorney’s fees.

Buyer expressly acknowledges that such damages may be substantial and agrees that the Breeder may pursue the full measure of legal and equitable relief available, including injunctive relief and monetary damages.

The Buyer agrees not to sell, gift, breed, or transfer ownership of this cat without the written consent of the Breeder.

SpaySecure Program

The Buyer acknowledges and agrees that participation in the SpaySecure Program is mandatory for all pet kittens placed by BlackMoon Maine Coons.

• The Sales Agreement is signed and the full deposit is paid prior to kitten assignment.
• Once a kitten has been assigned, the Buyer must sign the SpaySecure Agreement before pickup.
• SpaySecure, an independent verification service, will confirm proof of alteration directly with the Buyer’s veterinarian.
• This ensures compliance with the spay/neuter policy and supports responsible breeding ethics.

Section 7 — Acknowledgment and Entire Agreement

Both parties acknowledge that this document represents the entire agreement between the Buyer and BlackMoon Maine Coons. No other promises, representations, or conditions are binding unless stated herein.

This Agreement is governed by the laws of the State of New York.
